DataGun is a product of WeBuild Databases Inc. (“WeBuild Databases,” “we,” “our,” or “us”). This policy explains how we collect, use, and protect your information when you use the DataGun mobile application and the DataGun web application at app.thedatagun.ai (together, the “Service”).
1. Acceptance of Terms
By accessing or using DataGun, you confirm that you can form a binding contract with WeBuild Databases and that you accept these Terms. If you are using DataGun on behalf of a company or other entity, you represent that you have authority to bind that entity, and "you" refers to that entity.
2. Description of Service
DataGun extracts structured data (such as shipment, party, hazmat, product, volume, and driver information) from Bills of Lading, Air Waybills, and related freight documents that you capture or upload, and lets you review, save, export, and email that data. The Service is provided on a free trial basis, with optional paid tiers offering additional capture volume, team seats, history retention, and features. WeBuild Databases does not currently publish prices in the app; paid plans are arranged by contacting our team directly.
3. Accounts & Eligibility
You must provide accurate registration information and keep your login credentials confidential. You are responsible for all activity that occurs under your account, including activity by drivers or team members your organization invites. Notify us promptly at support@thedatagun.ai if you suspect unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or to submit documents you do not have the right to process;
- Attempt to access another tenant’s or user’s data, or circumvent any access control in the Service;
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law;
- Interfere with or disrupt the integrity or performance of the Service, including through automated scraping or excessive request volume; or
- Resell or provide the Service to third parties without our written consent.
5. Subscriptions & Payment
Free-tier accounts are subject to the capture, seat, and retention limits shown in the app. Paid tiers are arranged directly with our team; upgrades and downgrades take effect once confirmed by WeBuild Databases. We do not store payment card details within the Service itself.
6. Freight Document Data & Customer Responsibility
You are solely responsible for the accuracy of documents you submit and for verifying extracted data before relying on it for billing, compliance, or shipping decisions — DataGun’s AI extraction is a productivity aid, not a substitute for your own review. You represent that you have the necessary rights and consents to submit any personal or business data contained in a document you upload. See our Privacy Policy for how we handle that data.
7. Intellectual Property
WeBuild Databases retains all right, title, and interest in the Service, including its software, design, and branding. You retain ownership of the documents and data you upload. You grant us a limited license to process, store, and transmit that data solely to provide the Service to you (for example, generating extraction results and emailing reports at your request).
8. Disclaimers & Limitation of Liability
The Service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose. AI-extracted data may contain errors; WeBuild Databases is not liable for decisions made in reliance on unreviewed extraction results. To the maximum extent permitted by law, WeBuild Databases' aggregate liability arising from your use of the Service will not exceed the amount you paid us in the twelve months preceding the claim.
9. Termination
You may stop using the Service and request account deletion at any time by contacting us. We may suspend or terminate accounts that violate these Terms or pose a security risk to the Service or other users.
10. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles, and any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in New York.
11. Changes to These Terms
We may update these Terms periodically. We will update the “Last Updated” date above when we do. Continued use of the Service after a change constitutes acceptance of the revised Terms.
